By agreeing below, I acknowledge and agree to the following terms and conditions regarding my voluntary participation in the Delaware Youth Center Tractor Parade (“Event”):
1. Voluntary Participation
I understand that my participation in the Event is entirely voluntary. I knowingly and freely assume all risks associated with operating and/or riding on a tractor or related equipment in the parade, including but not limited to risks of personal injury, property damage, or loss.
2. Assumption of Risk
I understand that tractor operation involves inherent risks, including mechanical failure, collisions, uneven terrain, pedestrian interaction, weather conditions, and the actions of other participants or spectators. I voluntarily assume all such risks, whether known or unknown, foreseeable or unforeseeable.
3. Release and Waiver of Liability
I hereby release, waive, discharge, and hold harmless the Delaware Youth Center, its officers, directors, employees, volunteers, agents, sponsors, and affiliates from any and all claims, demands, causes of action, damages, losses, or liabilities arising out of or related to my participation in the Event, including but not limited to claims for:

Personal injury or death to myself or any passenger

Damage to or loss of my tractor, equipment, or other property

Injury to spectators, other participants, or third parties caused by my actions
This release applies whether such claims arise from negligence or otherwise, to the fullest extent permitted by law.
4. Responsibility for Passengers
I certify that any passengers riding on or in my tractor or equipment are riding at my own risk and with my permission. I accept full responsibility for their safety and conduct and agree that this waiver extends to any claims arising from their participation.
5. Alcohol and Drug Prohibition
I acknowledge that the consumption of alcohol, marijuana, illegal drugs, or impairing substances before or during the Event is strictly prohibited. I certify that I am not under the influence of any substance that could impair my ability to safely operate my tractor and agree that violation of this rule may result in immediate removal from the Event.
6. Compliance with Rules and Laws
I agree to comply with all Event rules, safety guidelines, instructions from Event staff or law enforcement, and all applicable local, state, and federal laws and regulations.
7. Non-Political Event Policy
I acknowledge that this Event is a non-political, family-friendly community event. The display, promotion, or distribution of personal political views, messages, endorsements, or materials is not permitted. This includes, but is not limited to, political signage, flags, banners, apparel, or paraphernalia.
I understand and agree that the Delaware Youth Center reserves the right, at its sole discretion, to remove or require the removal of any such items and/or to remove any participant from the Event for failure to comply with this policy.
8. Medical Consent
In the event of an emergency, I authorize Delaware Youth Center and its representatives to obtain medical treatment on my behalf if necessary. I understand that I am solely responsible for any medical expenses incurred.
9. Indemnification
I agree to indemnify and hold harmless Delaware Youth Center from any claims, damages, or expenses (including attorneys’ fees) arising from my actions, my tractor or equipment, or the actions of my passengers.
10. Severability
If any portion of this waiver is found to be invalid or unenforceable, the remaining portions shall remain in full force and effect.
11. Acknowledgment
I confirm that I have read this waiver in its entirety, understand its terms, and sign it freely and voluntarily. I understand that by signing this document I am giving up certain legal rights.
